The Long Wait for Justice: AMA Bank Depositors Call on BSP for Immediate Action



For more than five years, depositors of AMA Rural Bank of Mandaluyong, Inc. ("AMA Bank") have been left in the dark, unable to access their hard-earned money.  Many of them, particularly senior citizens, have worked tirelessly to secure justice, hoping for a resolution that will allow them to reclaim their deposits.  Their dissatisfaction has grown with each passing year, as legal and bureaucratic complications continue to delay the bank's reopening.  Tragically, some of these depositors died without seeing the resolution they had fought so hard for.




On March 1, 2023, the First Division of the Supreme Court ("SC First Division") issued an even-dated Resolution ("First SC Resolution") denying the respective SC Petitions of the Bangko Sentral ng Pilipinas ("BSP") and the Philippine Deposit Insurance Corporation ("PDIC") and affirming the CA Decision.  This ruling ordered the BSP to reopen AMA Rural Bank within five days and the PDIC to return seized funds and assets within the same time frame.

The Supreme Court En Banc then denied the BSP and PDIC's Motions for Reconsideration "with finality" in its Resolution dated May 28, 2024 ("Second SC Resolution").  The Supreme Court En Banc then issued an Entry of Judgment, confirming the First and Second SC Resolutions, which affirmed the CA Decision in CA-G.R.  SP No. 163288 has become final and executory on May 28, 2024.  






Following this decision, on March 5, 2025, a group of AMA Bank depositors returned to the BSP to voice their concerns. This visit comes after previous efforts, including a formal letter to BSP officials and a prior meeting, both of which sought clarification on the fate of their deposits. While the BSP has repeatedly stated that it does not oppose the reopening of AMA Bank, its actions suggest otherwise.

The root of the problem is the BSP's second Motion for Reconsideration (M.R.) filed with the Supreme Court, which strongly opposes the reopening of AMA Bank.  This contradiction has only heightened depositors' concerns.  If the BSP truly supports the reopening, why persist in legal maneuvers that prevent it? The depositors were informed about the second M.R.  remains under Supreme Court consideration, exacerbating the uncertainty surrounding their funds.

To make matters worse, AMA Bank has been denied access to nearly 2 billion pesos in legitimate funds held by PDIC, the Department of Education ("DepEd"), and the BSP itself.  Without these funds, even if AMA Bank were to reopen, it would struggle to function effectively.  The depositors are concerned that forcing a reopening without financial backing, while the BSP's second M.R. remaining pending would only expose AMA Bank to contempt of court, exacerbating the situation.

The prolonged suffering of AMA Bank depositors began on November 7, 2019, when the BSP issued Monetary Board ("MB") Resolution No. 1705.D ("MB Resolution No. 1705.D"), which ordered the closure and liquidation of AMA Bank, designated PDIC as the receiver of AMA Bank, and directed PDIC to proceed with the takeover and liquidation of AMA Bank.




On November 8, 2019, following the service of the Notice of Closure, PDIC implemented MB Resolution No. 1705.D and took over operations at AMA Bank's Head Office in Mandaluyong City, as well as nine (9) branches and three (3) Other Banking Offices (OBO) in various locations throughout the country, and took custody of all its records, documents, and assets, including cash assets.

However, in its Decision dated September 7, 2020 ("CA Decision"), the Court of Appeals granted, among other things, AMA Bank's CA Petition, by annulling and setting aside MB Resolution No. 1705.D and all acts done in pursuance thereof, and directing PDIC to (i) return all records, documents, and assets seized from AMA BANK, and (ii) nullify the orders issued in implementation of MB Resolution 1705.D.

In this CA Decision, the Court of Appeals ruled that the closure was illegal and ordered the BSP and PDIC to reopen the bank and return the seized assets. Despite this ruling, the bank has been closed for more than four years now.




During the BSP-AMA Bank meeting on March 5, 2025, BSP Deputy Governor Atty. Elmore Capule explained the BSP's side of the story.  However, rather than providing a concrete resolution or a clear plan of action, the BSP, through Atty. Capule asked the depositors to return after a month. This response only added to depositors' disappointment, as they had expected a more substantial update or commitment from the central bank. To add to their frustration, the BSP did not issue an official statement about the meeting, leaving depositors with more questions than answers.


Now, the depositors are making a direct appeal for BSP to:
  1. Withdraw the second motion for reconsideration and allow the Supreme Court’s ruling to take effect without further delay.
  2. Use its influence over PDIC, DepEd, and BSP itself to release AMA Bank’s rightful funds, ensuring that the institution can operate once more and fulfill its obligations to its depositors.

For the elderly depositors who have waited for years, time is no longer an option. Their call for justice is about more than just financial restitution; it is about fairness, accountability, and adherence to due process.  The BSP is now responsible for aligning its actions with its words and finally putting an end to this long-running financial nightmare.

AMA Bank depositors are demanding justice, which has been long overdue. Their plea is louder than ever: the BSP must act now.

The National Resilience Council’s colloquium proves resilience thrives in collaboration

National Resilience Council (NRC) Co-Chairman for the Private Sector Hans Sy, in his message of support, reiterates that resilience is a continuous journey and is a collective responsibility to build on progress, promote innovation, and ensure lasting impact.


The National Resilience Council (NRC) of the Philippines convened a diverse group of stakeholders for the event "From Surviving to Thriving: Transformative Strategies through Multi-Stakeholder Partnerships and Innovations." As a science and technology-driven public-private partnership, the NRC unites national and local governments, academia, civil society, and the private sector to advance the interconnected objectives of the Sendai Framework for Disaster Risk Reduction, Sustainable Development Goals, Paris Climate Agreement, New Urban Agenda, and other global commitments.

Held as the 2025 Resilient Local Government Unit Program (RGLUP) Colloquium, the event showcased progress and updates from participating cities and municipalities in the NRC’s Adopt a City (AAC) Initiative. This initiative enables corporations to move beyond disaster relief, investing in risk reduction through preparedness funding, prevention, pre-disaster recovery planning, and long-term resilience programs. By empowering local governments, AAC promotes collaborative efforts to build safer, more resilient communities.

The colloquium also welcomed NRC’s private and public sector partners, with notable participation from the Department of Environment and Natural Resources, the Department of National Defense, and the United Nations ARISE Private Sector Alliance for Disaster Resilient Societies – Philippine network. The event opened with inspiring messages from NRC Co-Chairman for the private sector and SM Prime Holdings Chairman of the Executive Committee Hans Sy, NRC Vice Chairman for civil service organizations and Zuellig Family Foundation President Austere Panadero, and NRC Vice Chairman for the scientific organizations and academe and Director of the Manila Observatory Fr. Jose Ramon Villarin, SJ.

Women on Fire 2025: Empowering Women, Building Resilient Communities



In recognition of National Women’s Month and Fire Prevention Month, SM Cares launched Women on Fire, a celebration of the remarkable leadership, strength, courage, and resilience of women in fire prevention, disaster response, and community safety. Through collaboration with key government agencies and private organizations, Women on Fire served as a platform for education, awareness, and empowerment, reaching over 25,000 participants across all initiatives.

Strengthening Preparedness and Safety

A key highlight of the campaign was Women on Fire, which recognized female firefighters, emergency responders, and community leaders for their role in safety, fire prevention and disaster preparedness. On March 4, 2025, SM Cares and the Bureau of Fire Protection (BFP) conducted the 4th SM & BFP Nationwide Simultaneous Fire Drill across SM malls nationwide, with SM Mall of Asia as the main venue. Hundreds of registered participants took part in the Fire Square Roadshow, engaging in fire safety demonstrations and interactive training sessions to strengthen preparedness.

Women in Resilience: Empowering Women as Leaders in Disaster Preparedness and Community Building

On March 5, 2025, SM Cares and the Philippine Commission on Women (PCW) led the 2025 National Women’s Month Celebration Kickoff at SM Mall of Asia. The event, centered on the theme “Babae sa Lahat ng Sektor, Aangat ang Bukas sa Bagong Pilipinas”, aimed to empower women across various sectors, particularly those from marginalized communities. Its activities included gender equality discussions on women’s rights and leadership, a trade fair showcasing products from women-led MSMEs and free services such as medical check-ups, legal consultations and livelihood support. 

Meanwhile, the Women LEAD Forum, co-hosted by the Department of the Interior and Local Government (DILG) and SM Cares, emphasized the crucial role of women at the barangay and grassroots levels in disaster resilience. The discussion underscored how women-led initiatives strengthen community preparedness and serve as models for national climate and disaster resilience programs.

To reinforce its commitment to creating safe environments, SM Cares held the 3rd Nationwide Safe Spaces Act Orientation on March 4 and 6, engaging more than 12,000 participants across 86 SM malls nationwide. This initiative educated students, employees, tenants, and security personnel on the importance of maintaining harassment-free spaces in malls and workplaces.

From Bin it Right to #SMWasteFreeFuture: How SM minimizes landfill impact

SM’s environmental programs, such as the monthly Trash to Cash recycling market, continue to support communities towards sustainable living.


It is not “out of sight, out of mind”; landfills are not just eyesores in remote areas, but they also pose a significant health risk to the communities around them and emit a substantial amount of greenhouse gases from decaying food waste.

The RDC, or Recyclable, Disposable, and Compostable bins at SM Supermalls, are not only for show but serve as the start of the journey to achieve a net-zero landfill and beyond.

For recyclable waste, SM has initiatives like the "Trash to Cash" recycling market, which successfully gathers over 1 million kilograms annually of plastic, paper, and other materials for reuse or recycling. The program aims to reduce solid waste pollution and promote a circular economy within communities. SM understands the importance of segregating at the source, and the company does this through partnerships with various companies, such as Trust International Paper Corporation for internal bulk paper recycling. The program has avoided landfill waste equivalent to the annual waste of more than 3,000 households while ensuring recyclables are properly processed.

For disposable, non-recyclable waste, SM Prime formed a joint venture with the Japanese environmental solutions company GUUN to establish SM GUUN Environmental Company, Inc. (SGECI). This partnership enhances its waste-to-fuel factory to convert non-recyclable waste, like single-use plastics, non-recyclable paper, and used rags, into cement fuel called “fluff fuel” to reduce coal usage. The “fluff fuel” produced is then used by eco-conscious cement companies like APO Cement, Holcim, and Taiheiyo Cement in a practice they call “co-processing,” where the ash from the fuel is also used as a cement ingredient, making it an integral part of the waste reduction ecosystem.

In 2024, SM GUUN Environmental Company converted over 6,000 metric tons of non-recyclable waste into “fluff fuel,” avoiding the annual landfill burden for 12,000 households. The Department of Environment and Natural Resources (DENR) recently visited the facility and recognized its significance to various stakeholders, particularly in the reduction of their carbon footprints and the efficient management of solid waste. 

For compostable waste, SM GUUN is experimenting with a Singaporean system for its malls and hawker centers that transforms compostable food residues into landscape soil, achieving over 70% volume reduction within 48 hours. This helps create new soil for gardens, parks, and golf courses, thereby reducing the burden on landfills and contributing to soil health and urban greenery.

SM has other customer-facing programs on solid waste management, like the Plastic Waste Collection program, E-Waste Collection, as well as awareness campaigns for clean water bodies and regular estero and coastal cleanup activities. These programs are also done to support the government in promoting responsible solid waste management through RA 9004, RA 11898, and similar laws.

With solutions identified, the journey towards SM’s #SMWasteFreeFuture becomes more realistic. It needs the help of everyone--from the proper way we “Bin it Right” to the further development of waste solutions to create an ecosystem of recovery and consumption where the word “waste” can be a thing of the past. SM Supermalls’ ‘Trash to Cash’ initiative empowers communities to build a waste-free future



Every first Friday and Saturday of the month, SM Supermalls transforms into a hub of sustainability through its nationwide ‘Trash to Cash’ (TTC) recycling market, where individuals can exchange recyclable waste for cash. This initiative, part of SM Supermalls’ Waste-Free Future campaign, has been a long-running program since 2007 that encourages waste segregation, recycling, and environmental awareness while also benefiting communities financially.

Held across 87 SM malls nationwide, the TTC program provides a convenient and accessible platform for shoppers, tenants, and local communities to participate in sustainable waste management. By ensuring that recyclables are properly sorted and repurposed, TTC actively contributes to the circular economy, reinforcing SM Supermalls’ commitment to responsible environmental stewardship.


Encouraging sustainable habits with tangible impact

The impact of TTC has been remarkable. In 2024 alone, the initiative successfully collected more than 12 million kilograms of recyclables, generating a total of over ₱28 million in earnings for participants. This is equivalent to 204,000 trees saved if all recyclable wastes are paper or a reduction of 18,000 tons of carbon emission if all recyclable wastes are plastic. More than just a recycling initiative, TTC empowers individuals, organizations, and businesses by making sustainability a rewarding and community-driven practice.

SM Prime champions sustainability with Water for Tomorrow Campaign

Pico Sands Hotel has reduced water consumption by advocating towel and linen reuse, inviting guests to join its sustainability journey and conserve water.


Access to clean and potable water is one of today’s most pressing challenges, with rapid urbanization and population growth straining freshwater resources. United Nations (UN)-Water emphasizes that effective water management is crucial for society and the environment.

SM Prime Holdings, Inc. (SM Prime), a leading integrated property developer in Southeast Asia, has prioritized water conservation and management since the early 1990s—long before water stress and its link to climate change became widely recognized.

Through Water for Tomorrow, SM Prime’s water stewardship campaign, the company actively integrates climate resilience into its developments, ensuring responsible resource management while supporting the well-being of the communities it serves.


Sustainable water management

Water conservation measures and efficient management systems are embedded in SM Prime’s building operations. The company invests heavily in sustainable water management technologies to reduce freshwater use and the demand for municipal water supply. It has identified practical water usage and innovations to address the growing concern of water security. 

In 2023, SM Prime’s reported total water consumption amounted to 7.2 million cubic meters, with 61% of that consumed water being recycled. 

On average, more than 1 billion gallons of recycled water is used for mall operations. SM Supermalls uses recycled water for cleaning and sanitation, caring for its plants and landscaping, and cooling its air conditioning towers.  Efficient plumbing and innovative water-saving technologies with low-flow fixtures also regulate the mall’s water consumption. 

These practices have been scaled throughout the group. The SM Offices’ E-Com Centers in the Mall of Asia Complex have sewage treatment plants that recycle greywater. Aside from rainwater harvesting systems that help maintain its urban gardens, SM Development Corporation (SMDC)’s Sea and Shore Residences donate its discharged treated water to the greening of the Estates in the MOA Complex. 

As part of its water conservation program in Pico Sands Hotel, SM Hotels and Convention Corporation reduced its freshwater consumption by 36%, reaching 52% water reuse and 41% for Pico de Loro Beach and Country Club. Together with Hamilo Coast, SM Prime’s luxury and leisure estates in Nasugbu, Batangas, its water desalination plant has made significant impacts on water management and sustainable eco-tourism since 2010, ensuring that it services all developments that call Hamilo home. 


Protecting water resources 

SM Prime supports this year’s UN-Water World Water Day 2025 on March 22, which focuses on the theme “Glacier Preservation.” 

Halfway around the globe, glaciers play a critical role in the global water cycle.  Glacial ice is the largest reservoir of fresh water, holding about 69% of the world’s fresh water. With rapid glacial melting, altered rainfall patterns, droughts, and rising sea levels, the planet risks a water crisis that affects the most vulnerable.

Recognizing these challenges and the need for a reliable water supply, SM Prime continues to integrate water-efficient systems in its property developments. This helps create public awareness and encourages responsible water use among mallgoers, tenants, employees, and communities. In 2023, SM Supermalls’ SM City Baguio rainwater treatment facility (RTF) was launched to help reduce dependence on freshwater sources. It has treated 17,000 cubic meters of rainwater into potable water and continues to operate and serve its host community.
